At about 9-10 minutes in, Damore says a month ago he published the memo to a ‘skeptics’ Google group, and then it went viral from there. I and probably others assumed that he sent the memo via his Google work email account to his work contacts, rather than posted to an official Google usenet-style bulletin board. This is a vital detail because it means if Google allowed other employees to post potentially controversial and opinionated content on that board with impunity, then singling out of Damore may be discrimination. But still, successfully suing employers is hard. For a lawsuit to have merit, a specific law must be broken (such as wage or discrimination laws).
